1. Agreement and Acceptance

These Terms and Conditions ("Terms," "Agreement," or "T&C") constitute a legally binding agreement between you ("User," "you," or "your") and Sanatan Vision - Pandit Ji platform ("Company," "we," "us," or "our") governing your access to and use of:

  • The Sanatan Vision - Pandit Ji mobile application and website (the "Platform")
  • Astrologer onboarding and registration services
  • User–Astrologer chat, audio call, and video call consultations
  • Astrology-related content, features, tools, and resources

By accessing or using the Platform, you acknowledge that:

  • You have read and understood these Terms and Conditions
  • You agree to be legally bound by all terms herein
  • You comply with all applicable laws and regulations
  • You accept our Privacy Policy and all incorporated policies

If you do not agree to these Terms, you may not access or use the Platform.

2. Registration and Eligibility

2.1 Age and Capacity Requirements

To register and use Sanatan Vision - Pandit Ji, you must:

  • Be at least 18 years of age
  • Be capable of entering into a legally binding contract under the Indian Contract Act, 1872
  • Possess the legal right and capacity to use the Platform

For Minors:

We do not allow users below 18 years of age to access or use the Platform. The Platform does not knowingly collect personal information from minors. The Company shall not be responsible or liable for any access, use, or consequences arising from use of the Platform by individuals under 18 years of age.

2.2 Account Registration

When registering, you agree to:

  • Provide accurate, truthful, and complete information
  • Provide correct birth details when requesting astrology services
  • Keep your information current and updated
  • Maintain confidentiality of your account credentials
  • Accept responsibility for all activities under your account

Providing false or misleading information may result in:

  • Suspension or termination of your account
  • Cancellation of services
  • Forfeiture of any fees paid

2.3 Account Security

You are responsible for:

  • Maintaining confidentiality of your password
  • All activities conducted under your account
  • Immediately notifying us of unauthorized access
  • Ensuring secure use of the Platform

The Company is not liable for losses caused by your failure to secure your account.

3. Description of Services

3.1 Platform Overview

Sanatan Vision - Pandit Ji operates as a technology platform that connects users with independent professional astrologers.

The Platform provides:

Astrologer Registration & Onboarding:

  • Astrologers can register and create professional profiles
  • Astrologers may list qualifications, experience, and areas of expertise
  • Identity and basic credential verification during onboarding

Astrology Consultation Services:

  • One-on-one consultations via: Chat, Audio call, Video call
  • Horoscope reading and interpretation
  • Birth chart and kundli analysis
  • Compatibility and matchmaking guidance
  • Career, relationship, and general life guidance
  • Suggested remedial measures (non-mandatory)

Pricing Control by Astrologers:

  • Astrologers independently set their own pricing during onboarding for: Chat consultations, Audio call consultations, Video call consultations
  • The Company does not influence or control individual astrologer pricing

Additional Platform Features:

  • Appointment scheduling
  • Consultation history
  • Secure payment processing
  • Ratings and reviews

3.2 Nature of Services and Disclaimers

Important Disclaimer:

The services provided on Sanatan Vision - Pandit Ji are for informational, educational, and entertainment purposes only and should not be considered as:

  • Professional financial advice
  • Medical or psychological diagnosis or treatment
  • Legal advice
  • Professional counseling
  • Substitute for professional services

Astrology is not an exact science. The Company:

  • Does not guarantee the accuracy of predictions
  • Does not guarantee specific outcomes or life experiences
  • Makes no warranty regarding prediction reliability
  • Provides services "as is" without warranties

User Responsibility:

  • You must exercise independent judgment
  • Make decisions based on your own discretion
  • Consult qualified professionals (doctors, lawyers, financial advisors) for professional advice
  • Not rely solely on astrological guidance for major life decisions

4. Astrologer Conduct and Obligations

4.1 Permitted Use

You agree to use the Platform:

  • Lawfully and in accordance with all applicable laws
  • For authorized purposes only
  • In a manner that does not infringe others' rights
  • Without harassing, threatening, or defaming others
  • Without transmitting harmful content

4.2 Prohibited Activities

You shall NOT:

  • Violate any applicable laws or regulations
  • Infringe intellectual property rights
  • Harass, stalk, threaten, or defame others
  • Transmit spam, malware, or viruses
  • Attempt unauthorized access to the Platform
  • Reverse engineer or decompile the Platform
  • Copy or scrape content without permission
  • Impersonate other users or entities
  • Engage in fraudulent activities
  • Use bots or automated tools (except as authorized)
  • Exploit the Platform for commercial purposes
  • Share passwords or account credentials
  • Engage in sexual or illegal conduct
  • Provide false information to astrologers
  • Request services for illegal purposes
  • Create duplicate accounts
  • Abuse refund or payment systems

4.3 Content Responsibility

Any content you provide (queries, messages, images, feedback):

  • Must be truthful and accurate
  • Should not violate others' rights
  • Must not contain illegal or harmful material
  • You grant the Company a license to use for service improvement (with anonymization)

4.4 Consequences of Violations

The Company may, without liability:

  • Suspend your account temporarily
  • Permanently terminate your account
  • Forfeit unpaid fees
  • Report illegal activities to authorities
  • Pursue legal action
  • Restrict your access to specific services

5. Payment Terms and Pricing

5.1 Pricing Structure

  • All prices are displayed in Indian Rupees (INR) unless specified
  • Prices are subject to change with notice
  • Consultation prices are set independently by astrologers
  • Platform service fees and applicable taxes (including GST) may apply

Additional Charges:

  • Applicable taxes (GST) will be added
  • Transaction fees from payment gateways may apply
  • International transaction fees (if applicable)
  • Premium astrologer consultations may have higher rates

5.2 Revenue Sharing Model

For every successful and completed consultation conducted through the Sanatan Vision - Pandit Ji platform, the total amount paid by the user shall be shared as follows:

  • 70% (Seventy Percent) of the total consultation fee shall be credited to the astrologer's wallet and shall be eligible for withdrawal, subject to applicable terms.
  • 30% (Thirty Percent) of the total consultation fee shall be retained by Sanatan Vision - Pandit Ji as a platform service fee, covering technology, marketing, payment processing, and operational costs.

5.3 Rate Changes

Astrologers may revise their per-minute rates at any time via the astrologer dashboard. Updated rates will apply only to new consultations initiated after the change.

5.4 Payment Methods

Accepted payment methods:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • UPI and net banking
  • Digital wallets (Apple Pay, Google Pay, etc.)
  • Bank transfers

Payment Security:

  • All payments processed through PCI-DSS compliant gateways
  • Your card information is encrypted
  • We do not store complete card details
  • Payment processor privacy policies apply

5.5 Billing

For Consultations:

  • Payments must be completed after consultations
  • Invoices are available in the user dashboard
  • Failed payments may result in service suspension

Invoice Generation:

  • Invoices generated for all transactions
  • Available in your account dashboard
  • Includes GST and itemization
  • For accounting and tax purposes

6. Refunds and Cancellations

6.1 Refund Policy

Consultation Refunds:

  • Refund request must be submitted within 48 hours of consultation
  • Grounds for refund:
    • Astrologer did not provide service
    • Technical issues prevented consultation
    • Payment processed twice
    • Service quality significantly below standard
  • Refunds will be issued within 5-7 business days to original payment method

Non-Refundable Items:

  • Services already rendered and consumed
  • Reports and documents downloaded
  • One-time payments for reports/documents
  • Services used beyond refund window
  • Refunds requested after 30 days

6.2 Right to Refuse Service

The Company reserves the right to:

  • Refuse service to any user
  • Refund and terminate account
  • Provide no reason for refusal
  • Not honor refund requests after service is fully rendered

7. Intellectual Property Rights

7.1 Company's Intellectual Property

All content on the Platform is the exclusive property of Sanatan Vision - Pandit Ji or licensed content providers:

  • Website design and layout
  • Logos, trademarks, and branding
  • Written content and articles
  • Video and audio content
  • Software code and architecture
  • Databases and compilations

Ownership: These remain the exclusive property of the Company or rightful owners. No ownership is transferred to you.

7.2 Restrictions on Use

You may NOT:

  • Copy, modify, or distribute content
  • Create derivative works
  • Reproduce birth charts or reports for commercial use
  • Sell or distribute our services
  • Use algorithms or methodologies without permission
  • Create competing astrology tools based on our content
  • Reverse engineer or decompile software
  • Use content for automated processing
  • Store large amounts of content
  • Access via bots or scrapers

7.3 Your Content

Your Query and Consultation Data:

  • You retain ownership of your personal information
  • We may use anonymized data for improvement
  • AI training may use anonymized queries
  • Historical data may be used for algorithm enhancement
  • You can request deletion (subject to legal holds)

User-Generated Content:

  • Feedback, ratings, and reviews become our property
  • We can use, modify, and display without compensation
  • Can be used in marketing materials
  • Attribution not required

8. Limitation of Liability

8.1 Platform Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW:

Sanatan Vision - Pandit Ji provides the Platform "AS IS" and "AS AVAILABLE." The Company makes no warranties, representations, or guarantees, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Accuracy, reliability, or completeness of Platform features
  • Continuous, uninterrupted, or secure access
  • Error-free operation
  • Compatibility with all devices or networks
  • Availability of customers or consultations
  • Earnings, income, or consultation volume

8.2 Service & Technical Limitations

The Company does not guarantee or warrant that:

  • The Platform will operate without interruptions, errors, or delays
  • Technical issues will be resolved immediately
  • The Platform will be free from bugs, malware, or viruses
  • Customer demand or consultation requests will be consistent
  • Minimum earnings, engagement, or visibility will be achieved
  • Payment processing will be uninterrupted
  • Data storage, backups, or security will be flawless

Astrologers acknowledge that service availability may be affected by technical issues, maintenance, third-party service providers, or external factors beyond the Company's control.

8.3 No Liability for Astrologer Outcomes

Sanatan Vision - Pandit Ji shall not be liable for:

  • Any advice, guidance, predictions, or consultations provided by astrologers
  • Outcomes, interpretations, or consequences of astrological services
  • Customer dissatisfaction, disputes, or complaints
  • Loss of income, clients, or reputation
  • Account suspension or reduced visibility due to policy violations
  • Emotional distress, business losses, or professional impact
  • Any indirect, incidental, special, or consequential damages

Astrologers are solely responsible for the content, quality, and legality of the services they provide.

8.4 Limitation of Liability

IN NO EVENT SHALL Sanatan Vision - Pandit Ji BE LIABLE FOR:

  • Any damages exceeding the total commission or fees earned by the astrologer on the Platform during the preceding twelve (12) months
  • Loss of profits, business opportunities, or goodwill
  • Loss of data or account information
  • Reputational harm or indirect losses

Maximum Liability: Limited strictly to the amount payable (if any) to the astrologer for the specific service giving rise to the claim.

8.5 Indemnification

You agree to indemnify, defend, and hold harmless Sanatan Vision - Pandit Ji, its directors, employees, and partners from any claims, losses, damages, liabilities, or expenses arising out of:

  • Your use of the Platform
  • Services, predictions, or advice provided by you
  • Violation of these Terms or Platform policies
  • Misrepresentation, misleading information, or false claims
  • Customer disputes, complaints, or legal claims
  • Payment disputes, chargebacks, or refunds caused by your conduct
  • Infringement of third-party rights

9. Astrologer Services and Professional Conduct

9.1 Astrologer Status and Qualifications

As an astrologer registered on Sanatan Vision - Pandit Ji, you acknowledge and agree that:

  • You operate as an independent service provider and not as an employee, agent, or representative of the Company.
  • You are responsible for possessing the necessary knowledge, education, training, and certifications relevant to the astrology services you offer.
  • You consent to identity, credential, and background verification as required by the Company during onboarding or at any time thereafter.
  • You must uphold professional conduct and ethical behavior at all times while using the Platform.
  • You agree to meet and maintain the service quality standards prescribed by the Company.

Verification Disclaimer: While the Company may verify certain credentials and documents submitted by you, Sanatan Vision - Pandit Ji does not guarantee or endorse the accuracy, effectiveness, or expertise of any astrologer's advice or predictions.

9.2 Professional Conduct and Service Standards

By offering services through the Platform, you agree to:

  • Maintain strict confidentiality of all user information and consultations.
  • Provide guidance in a responsible, ethical, and respectful manner.
  • Refrain from making guarantees, assurances, or absolute claims regarding outcomes or predictions.
  • Decline and report any requests involving illegal, unethical, or harmful activities.
  • Maintain appropriate professional boundaries with users at all times.
  • Respond to users in a timely and professional manner during consultations.
  • Respect the privacy, dignity, and beliefs of all users.

9.3 Disputes and Complaints Involving Astrologers

In the event of any dispute or complaint related to your services:

  • Users may first attempt to resolve the matter directly with you.
  • If unresolved, the matter may be escalated to Company support with relevant details and evidence.
  • You agree to cooperate fully with any investigation conducted by the Company.
  • The Company may review the matter and take appropriate action, including mediation, warnings, suspension, or removal from the Platform.
  • The Company's decision shall be final and binding.

Limitation of Liability: Sanatan Vision - Pandit Ji shall not be liable for:

  • Any advice, guidance, or predictions provided by you
  • The quality, accuracy, or outcome of your services
  • Any breach of professional or ethical obligations by you
  • Any conflicts, losses, or disputes arising between you and users

9.4 Refund Policy Related to Astrologer Services

You acknowledge and agree that refunds may be issued to users only under the following circumstances:

  • You fail to provide the agreed consultation service
  • The consultation is prematurely terminated due to your actions or unavailability
  • Technical issues attributable to the astrologer disrupt the consultation

Refunds shall not be granted for:

  • User dissatisfaction with predictions or advice
  • Outcomes resulting from advice not being followed
  • Personal expectations or beliefs regarding astrology results

10. Termination and Account Closure

10.1 Account Termination by User

You can terminate your account by:

  • Logging into account settings
  • Selecting "Close Account" or "Delete Account"
  • Confirming termination
  • Account closed within 24-48 hours

Upon Termination:

  • Access to services immediately revoked
  • Consultation history deleted (unless retained for legal reasons)
  • Pending services cancelled
  • Remaining credits forfeited
  • No refund for remaining balance

10.2 Termination by Company

The Company may terminate your account if you:

  • Violate these Terms and Conditions
  • Engage in illegal activities
  • Harass, threaten, or harm others
  • Attempt to defraud the platform
  • Provide false information
  • Misuse services
  • Violate payment terms

Termination Effects:

  • Immediate access revocation
  • Forfeiture of credits and balances
  • Possible legal action
  • No refund provided
  • Data retained as per privacy policy

10.3 Account Deactivation

Alternatively, you can:

  • Deactivate your account temporarily
  • Access restored upon reactivation
  • Data preserved during deactivation
  • Can remain deactivated for up to 1 year

10.4 Data Upon Termination

After account termination:

  • Personal data retained per legal requirements
  • Consultation data may be deleted per request
  • Payment records retained for 7 years
  • AI training data anonymized and retained
  • You will receive data deletion confirmation

12. Confidentiality and Privacy

Both parties agree to:

  • Keep each other's information confidential
  • Use confidential information only for service purposes
  • Protect information with reasonable security
  • Not disclose without consent (except legally required)

12.2 Astrologer-User Confidentiality

Astrologers agree to:

  • Keep your consultation private
  • Not share details with third parties
  • Not use your information for other purposes
  • Maintain professional confidentiality

Exceptions:

  • Company staff for support purposes
  • Law enforcement with legal process
  • Your explicit authorization
  • Safety or legal necessity
